Back to Court - Michigan Citizens for Water Conservation
Fall 2007 Project Grant Award: $1,500
Fall 2007 Technical Grant Award: $3,500
Project Summary:
In a four to three decision, the Michigan Supreme Court in the Michigan Citizens for Water Conservation v Nestlé agreed with lower court rulings that Nestlé's pumping for its Ice Mountain bottled water operation harmed Dead Stream, Thompson Lake, and adjacent wetlands. However, the Supreme Court reversed part of the lower court's ruling by limiting MCWC's standing to bring suit against Nestlé under Michigan's Environmental Protection Act to prevent Nestlé from causing undeniable harm to the water resources of the state. When the Supreme Court renders its opinion, MCWC will face ongoing court proceedings and costs to address standing in the wetlands issue, requesting the trial court to explain the undisputed unreasonable harm, and to ask for adjustment of pumping limits. The grant will help with these costs. In addition, the grant will help to continue to educate citizens on the issue.
